A bunch of Princely States with a desert spring known as Ajmer-Merwara, a British India Territory, was given topographical articulation as Rajputana. These Twenty and odd Rajputana States before twentieth Century AD were dynastic and the Rulers were the wellspring leader of all Executive, Legislative and Judicial Authority in the States. When the nation got opportunity from British Imperialism, the procedure of reconciliation of the august States to shape greater units was started.

The State of Rajasthan was shaped during the period March 17, 1948 and January 25, 1950 by joining of 19 Princely States. The Union of Rajasthan was initiated at Jaipur by Sardar Vallabh Bhai Patel on March 30, 1949. Around then Jaipur, Jodhpur, Udaipur, Bikaner and Kota were the main states with pretty much British style of Administrative set up. They had their own High Courts with a subordinate legal framework. Prior to initiation of the new State, an advisory group comprising of Shri B.R.Patel, the then Chief Secretary to the Government of PEPSU, Lt. Col. T.C.Puri, Director of Health Service and Shri S.P.Sinha, Superintending Engineer, CPWD, was established to determine the issues identifying with area of the capital and the seat of the High Court. The board presented its report on March 27, 1949 with a proposal that Jaipur ought to be made capital of the new State and the High Court ought to be situated at Jodhpur. In the recently made State, five High Courts were working at Jaipur, Jodhpur, Bikaner, Udaipur (being capital of United Rajasthan with a seat at Kota) and Alwar (being capital of Matsya State) with an absolute quality of 20 appointed authorities. The Rajasthan High Court Ordinance, 1949 canceled these various locales and accommodated a solitary High Court for the whole State. Segment 10(1) of the Ordinance set out that “the High Court will sit at Jodhpur and such other spot or places, assuming any, as the Rajpramukh may now and again select either for all time or for a predetermined period”. Sub-segment (2) of Section 10 enabled the Chief Justice to select at least one of such appointed authorities of the High Court to sit at such spot or places as he may coordinate. In exercise of forces under sub-section(3) of Section 1, the Rajpramukh of the State gave a notice on August 25, 1949 fixing the 29th day of August, 1949 as the date for introduction of the High Court of Judicature for Rajasthan at Jodhpur. Around the same time the Rajpramukh practicing the forces gave by sub-segment (1) of Section 10 of the Ordinance coordinated that until further requests the High Court of Judicature for Rajasthan will likewise sit at the same time (1) at Jaipur to discard the work emerging in the Jaipur and Kota divisions and (2) at Udaipur to discard the work emerging in Udaipur division.
